Kaarwa – Seller Contract


I. Seller Policy (For Businesses Listing on Kaarwa)

1. Product Listing & Compliance

  • Sellers must ensure accurate product details, pricing, and stock availability.
  • Items listed must comply with local legal and safety regulations.
  • Any fraudulent or misleading listings may lead to permanent suspension.

2. Order Management

  • Sellers must accept or reject orders within a defined time limit.
  • Frequent order rejections or stockouts may lead to penalties or listing suspension.
  • Once an order is accepted, the seller is responsible for fulfilling it within the committed timeframe.

3. Payment Process

  • Kaarwa does not handle transactions. Buyers pay sellers directly via UPI or other methods.
  • Sellers are responsible for issuing refunds if required.
  • Kaarwa is not liable for payment disputes between buyers and sellers.

4. Platform Fees

  • Monthly Subscription Plans: Basic and Premium (Subscription fee is subject to future revision)
  • Per Order Fee: ₹10 per confirmed order/delivery order (subject to future revision).
  • Delivery Fee: If sellers opt for Kaarwa delivery, a prepaid delivery fee is required.

5. Dispute Resolution

  • In case of complaints, sellers must respond to buyers within 24 hours.
  • Kaarwa may mediate disputes but is not liable for refunds or compensation.
  • Sellers failing to resolve repeated complaints may be removed from the platform.

II. Delivery & Logistics Policy (For Sellers Using Kaarwa Delivery Service)

1. Delivery Options

  • Sellers can either self-deliver or use Kaarwa’s delivery service through delivery partners integration.
  • If choosing Kaarwa Delivery Service, sellers must pay the delivery fee upfront.
  • Kaarwa does not cover refund requests due to delays or failed deliveries happened.

2. Timely Dispatch

  • Sellers must prepare the order within 10-15 minutes of acceptance.
  • Delayed preparation leading to missed pickups may result in cancellation/refunds.
  • Kaarwa reserves the right to cancel pickup requests if the seller delays order processing.

III. Buyer Policy (For Customers Ordering via Kaarwa)

1. Order Placement & Payment

  • Buyers place orders on Kaarwa but pay sellers directly.
  • Kaarwa is not responsible for payment failures, refunds, or order disputes.
  • Buyers should check product availability and verify seller ratings before ordering.

2. Order Cancellation & Refunds

  • Buyers can cancel orders before seller acceptance (if allowed by the seller).
  • Once accepted, cancellation depends on the seller’s policy.
  • Refund requests must be directed to the seller (Kaarwa does not handle payments/refunds).

3. Dispute & Complaint Handling

  • Buyers can report late deliveries, wrong products, or missing items.
  • Kaarwa may facilitate communication between buyer and seller but will not issue refunds.
  • If a seller is found to be repeatedly involved in disputes, their listing may be removed.

IV. Dispute & Liability Policy (For Buyer-Seller-Delivery Issues)

1. Kaarwa’s Role in Disputes

  • Kaarwa only provides the platform & delivery service and does not participate in transactions.
  • If disputes arise, Kaarwa may act as a mediator but will not refund or compensate users.
  • Kaarwa may issue warnings or take action against sellers with excessive complaints.

2. Fraud Prevention

  • If any seller is found scamming buyers, they will be blacklisted and removed from Kaarwa.
  • Buyers found misusing the platform (false complaints, abuse, etc.) may face account restrictions.
  • Kaarwa reserves the right to take legal action against fraudulent users.

V. Community & Content Policy

1. Appropriate Listings

  • Sellers must not list illegal, counterfeit, or prohibited items.
  • Any violation may result in immediate removal from the platform.

2. User-Generated Content

  • Reviews, comments, and feedback must be constructive and respectful.
  • Hate speech, discrimination, or misleading content is strictly prohibited.

3. Account Suspension & Penalties

  • Kaarwa reserves the right to suspend or ban accounts violating platform policies.
  • Users engaging in harmful activities may face legal consequences.

Final Terms & Conditions

  • By using Kaarwa, sellers, buyers, and delivery personnel agree to all stated policies.
  • Kaarwa reserves the right to update policies as needed.
  • Continued use of the platform implies acceptance of all policies.
  • This Agreement and the Privacy Policy shall be governed in all respects by the laws of Indian Territory. Kaarwa considers itself and intends itself to be subject to the jurisdiction of the Courts of Faridabad, Haryana, India only. The parties to this Agreement hereby submit to the exclusive jurisdiction of the Courts of Faridabad, Haryana, India.
